The City is currently constructing a roofed pavilion at the Community Garden located at 1200 NW 1St Street. The improvement is being funded with $242,000 of CDBG funds

 

Description of Action

The County has reviewed the applications associated with this project and has notified the City that any roof structure where an activity is occurring is subject to impact/concurrency fees. The estimated impact fee for the pavilion is $51,245. However, such impact/concurrency fees can be waived by establishing the following restriction on the structure as described in the attached resolution: the 5,850 square foot structure will not be used as a market place or similar use from Monday through Friday between 4 PM and 6 PM and the roof structure will be exclusively utilized for ancillary purposes for the City’s Community Garden. If and when the City desires to expand the use of the pavilion, Broward County impact fees may be paid at such time.
